Here's the problem. That map is not settled. Virginia Beach is in the middle of redrawing exactly where short-term rentals are allowed to operate, and the version the city is currently considering would remove eligibility from a stretch of the resort area that has it today. The Boundary Is Moving While You're Touring Homes

Right now, short-term rentals are broadly permitted with a zoning permit inside two designated districts: the Oceanfront Resort area and the Sandbridge Special Service District. Everywhere else in the city, an STR has to qualify through grandfathering or it isn't legal, permit or no permit.

In late May 2026, city zoning administrator Hannah Sabo presented the Resort Advisory Commission's parking subcommittee with a plan to redraw the Oceanfront overlay's western boundary, pulling it back from North Birdneck Road. Under that version of the map, the Resort Beach neighborhood, Atlantic Park, and the area around the convention and sports center would fall outside the permissible zone entirely.

The Planning Commission was originally supposed to issue a formal recommendation by July 20. Instead, on July 8, it deferred final action on the boundary for more public outreach. As of this writing, no new hearing date has been set. That means the map a buyer sees today, whether it's on the city's zoning portal or screenshotted by an agent, is a snapshot of a debate that hasn't ended.

Being Inside the Line Doesn't Mean You're Legal

Even the city's own numbers show why the boundary alone isn't the full answer. Under the redrawn footprint currently on the table, 281 STRs would be compliant and 107 would not, and the city says it's actively working with those noncompliant operators to bring them into line. Translation: geography gets you into the conversation, but registration history and permit status decide whether you're actually allowed to operate.

The flip side matters just as much for anyone eyeing a property that's inside the current overlay but would land outside a redrawn one. Those properties could be grandfathered, but the grandfathering comes with teeth. A dwelling can't be expanded by more than 25 percent or 1,000 square feet, whichever is smaller, without losing that status. Those existing arrangements would be grandfathered if the change goes into effect, but no new garage leases would be permitted going forward.

If a property you're considering doesn't have enough on-site parking to meet the bedroom count, and the plan was ever "we'll just lease a garage spot," that plan is now closed to any new STR registration. This is worth checking regardless of where the overlay boundary ends up, because it's already decided.

Over the three months ending May 2026, Virginia Beach home prices rose 5.1 percent year over year to a median sale price of $415,000, with homes typically fielding two offers and going under contract in about 23 days.
